1.1. Our mission is to provide a high-quality service to our users, and we want you to feel safe and confident when using the “ECOFACTOR Network” mobile application (hereinafter — the mobile application) and the website https://ecofactortech.com/ (hereinafter — the website).

1.2. We take your privacy and data protection seriously. This Privacy Policy has been prepared in accordance with the General Data Protection Regulation (GDPR), effective in the European Union since 25 May 2018 (EU-DSGVO No. 2016/679, hereinafter — “DS-GVO”).

1.3. Pursuant to Art. 4(1) DS-GVO, personal data means any information relating to a natural person who is identified or identifiable. An identifiable natural person is one who can be identified, directly or indirectly. More detailed information on this can be found in Art. 4(1) DS-GVO. IP addresses are also considered personal data; they are transmitted (anonymised) to our web server when our website and mobile application are accessed. You can find out more about this below.

1.4. Please take a few minutes to read this document in order to understand what information we collect, how we use it, and your rights with regard to your data.

2. Collection and Processing of Personal Data

2.1. We may collect, store and use the following types of personal data:

Information about your device and your use of the mobile application (including device type, OS version, IP address, geolocation, session frequency, etc.);

Data you provide when registering in the application (first name, last name, email address, phone number, country, billing address, licence plate number and type of the vehicle you own);

Information about your current location (coordinates, speed, altitude, timestamp);

Information related to your use of application features such as charging, booking and payments;

Data related to purchases or transactions (name, billing address, email, partial card data — processed via secure payment providers);

Any other information that you voluntarily provide while using the application.

2.2. Cookies. In various places on our website, in addition to server-side log files, we use so-called cookies, by means of which we process usage data directly via the web browser of the end device you are using (for example, a PC, tablet or smartphone). Cookies are small files in text format which are either sent from a web server to the web browser via your internet browser, or generated in the web browser by means of a script (for example, JavaScript), and then, when you visit the website again using the same end device, they are either sent back to the website that generated them (provider cookies / first-party cookies) or sent to another website or an external online service provider (for example, via a plug-in) to which they belong (third-party cookies / third-party files). As a result, the website automatically recognises that it has already communicated with this browser before and identifies the web browser being used.

Some cookies are technically necessary, as they primarily make it possible to use our website and thus make it fit for use.

The use of technically necessary cookies is required to ensure the proper and secure operation of our websites and their functions, as well as to ensure the availability of our website as a whole. These cookies are set, for example, to ensure the operation of the basic functions of the website, to save your cookie settings, to ensure secure authentication allowing you to log in to your customer account, and to fill in forms. This is necessary, for example, to ensure the following functions / achieve the following purposes:

The legal basis for this data processing is Art. 6(1)(b) (contract initiation, conclusion of a contract) DS-GVO, § 25(2) No. 2 TTDSG.

With regard to the data processing necessary for the operation of the website, you have no right to object.

Marketing, statistical / analytical cookies.

In accordance with legal requirements, the storage of information on end devices (desktop computers, mobile phones, tablets, etc.) — for example, by setting cookies that are not technically necessary — and the retrieval of information from end devices for tracking purposes are generally only permitted with your prior consent. We obtain such consent by means of the cookie settings.

The legal basis for such data processing is Art. 6(1)(a) (consent) DS-GVO, § 25(1) TTDSG.

Right of withdrawal: You have the right to withdraw, with effect for the future, your consent to the use of personal data obtained by means of marketing, statistical/analytical cookies.

To do so, you can make the necessary changes in the cookie settings in the navigation menu or change the settings in your browser.

Withdrawal of consent means that no further data will be transmitted to our website from the end

device you were using when submitting the objection.

2.4. We may — even without your express consent — send you advertising content by email. You will be informed about the possibility of your email address being used for this purpose and about your right to object to it.

The legal basis for such data processing is § 7(3) UWG as well as Art. 6(1)(f) DS-GVO.

Right to object: At the end of each email you will be given the opportunity to object to the further use of your email address for the above purpose in the future.

2.3. In addition to the data collected through the mobile application, we also collect personal data through our website https://ecofactortech.com/, in particular:

First name, last name, email address, phone number and message text provided via the feedback forms on the website;

Contact details and address provided via order forms or service request forms;

Email address provided for subscribing to the newsletter;

Data collected automatically by means of cookies and web analytics tools (in particular Google Analytics): IP address, browser type, operating system, pages visited, time spent on the website and referral source.

These data are used to process your requests, provide services, improve the operation of the website and send informational materials.

3. Use of Personal Data

3.1. Personal data collected through the mobile application may be used for the following purposes:

Administration and support of the mobile application;

Providing access to the charging, booking and payment functionality;

Personalising your experience in the application;

Providing the services you request;

Sending service notifications, receipts and confirmations;

Sending push notifications;

Sending marketing communications (only with your consent);

Sending SMS or messenger updates (only with your consent);

Providing anonymous usage statistics to our partners (without identifying the user);

Processing requests and enquiries addressed to the customer support service;

Ensuring compliance with our Terms of Use.

3.2. You can adjust your privacy settings in the application (for example, hide your phone number or disable marketing communications).

4. Disclosure of Personal Data

4.1. We may share your personal data:

With our employees, contractors or professional advisers — to the extent necessary;

With partner companies (for example, charging station operators) — when you use or book their services;

With payment service providers — for the secure processing of transactions;

With authorised state authorities — where required by law;

In the context of a business acquisition or sale — with the new owners.

4.2. We do not sell your personal information to third parties.

4.3. In addition, authorities and state institutions, such as tax authorities, prosecution offices or courts, and other state bodies to which we (must) transfer personal data for legally compelling reasons or for the protection of legitimate interests. In such a case, the transfer takes place on the basis of Art. 6(1)(c) DS-GVO, provided we are entitled to transfer the data by virtue of legal obligations.

5. International Data Transfer

5.1. Your data may be stored and processed on servers outside your country of residence, including in the EU or the USA.

5.2. By using the mobile application, you consent to such international data transfer, subject to compliance with appropriate safeguards (for example, standard contractual clauses, protected data processing centres).

5.3. If data are transferred to entities whose registered office or place of data processing is not located in a member state of the European Union or in another state party to the Agreement on the European Economic Area, before the transfer we will make sure that, except in exceptional cases permitted by law, an adequate level of data protection is ensured at the recipient (for example, by means of an adequacy decision of the European Commission, appropriate safeguards, or an agreement on the so-called standard contractual clauses of the European Union (SCC) concluded with the recipient) and that additional technical and organisational security measures are applied, or you give your consent to the data transfer.

The legal basis for the data processing is Art. 6(1)(b) DS-GVO (performance of a contract) and, where applicable, the protection of legitimate interests in the context of the provision of services in accordance with Art. 6(1)(f) DS-GVO.

6. Data Storage and Deletion

6.1. We store your personal data only for as long as is necessary to fulfil the stated purposes or — in the case of consent — until you have withdrawn your consent. In the event of an objection to processing, we will delete your personal data, except where their further processing is permitted by the relevant legal provisions. We will also delete your personal data if we are obliged to do so for other legal reasons.

6.2. We may retain data for a longer period if:

This is required by law;

This may be relevant to ongoing or potential legal proceedings;

This is necessary to protect our legitimate interests (for example, fraud prevention).

7. Security of Personal Data

7.1. We apply appropriate technical and organisational measures to protect your data against unauthorised access to, loss of or misuse of your personal data.

9.1. You have the right to:

Receive information from us about the processing of your data. For this purpose, you may exercise the right of access to the personal data we process about you.

Require us to rectify incorrect data. You may request that your data be supplemented or deleted, unless this conflicts with the requirements of the law. This does not apply to data that are necessary for invoicing and accounting purposes or that are subject to a statutory data retention obligation.

Withdraw your consent to data processing at any time by contacting the support service;

Delete your account and all personal data (via “Profile Settings” → “Delete Account”);

Opt out of marketing communications at any time.

10.1. We use analytics tools (for example, Google Analytics) to monitor the use of the application and improve the user experience.
